Congressman Aderholt Introduces Constitution Restoration Act

"This legislation will allow states to recognize the fundamental precepts upon which our Constitution and government are based," said Congressman Aderholt.

WASHINGTON, March 3, 2005 - Congressman Robert Aderholt (R-Haleyville) today re-introduced "The Constitution Restoration Act" (H.R. 1070), which would require federal courts to operate within the jurisdiction set by our founding fathers within the United States Constitution as it pertains to the public acknowledgment of God as the sovereign source of law, liberty, and government.

"When federal courts unconstitutionally prohibit the acknowledgment of God, the courts deny the very source of life, liberty, and the pursuit of happiness which our founding fathers specifically recognized in the Declaration of Independence," said Congressman Aderholt. "Trying to forbid our public officials from recognizing God is a clear violation of the Constitution's Tenth and First Amendments and goes completely against the grain of the writings of our founding fathers. In fact, it undermines the principles on which our republic was based. It is fully appropriate for today's state and federal officials to recognize God in oaths, mottos, documents, prayers, and on monuments. We must protect that right.

"Congress has the duty under Article III to regulate the appellate jurisdiction of the U.S. Supreme Court and other federal courts. This is a provision that the founders included as a check on the Judicial Branch to prevent it from exceeding its jurisdiction. The Constitution Restoration Act will restore and preserve the acknowledgment of God to our law and government," added Congressman Aderholt.

"Therefore, whether it is a public display of the Ten Commandments, the Pledge of Allegiance in the classroom, or a national motto 'in God we trust,' all would be protected since it is in essence the acknowledgment of God."

H.R. 1070 has been referred to the House Committee on the Judiciary. Senator Richard Shelby (R- Ala.) has introduced identical legislation in the United States Senate.
